<h4>1 About the Application </h4><p>1.1 Welcome to Leonie’s Caring’s Rostering App (the 'Application').. By accessing or using our App, you agree to comply with the following terms and conditions set forth by Leonie’s Caring ("we," "us," or "our"). These Terms govern the use of the app and the services provided through it. If you do not agree with these Terms, please refrain from using the App. </p><p>1.2 The Application is operated by Leonie’s Caring (ABN 26319932278). Access to and use of the Application, or any of its associated Products or Services, is provided by Leonie’s Caring. Please read these terms and conditions (the 'Terms') carefully. By using, browsing and/or reading the Application, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Application, or any of its Services, immediately. </p><h4>2 User Eligibility </h4><p>2.1 To use our App, you must be at least 18 years of age and legally capable of entering into a binding contract. By using this App, you confirm that you meet these eligibility requirements. </p><h4>3 Account Registration </h4><p>3.1 You may be required to create an account in order to access certain features of the App. You agree to provide accurate, current, and complete information during the registration process and keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. </p><p>3.2 In order to access the Services, you must first register for an account through the Application (the 'Account'). </p><p>3.3 As part of the registration process, or as part of your continued use of the Services, you may be required to provide personal information about yourself (such as identification or contact details), including: </p><p> a) You warrant that any information you give to Leonie’s Caring in the course of completing the registration process will always be accurate, correct and up to date. </p><p> b) Email address </p><p> c) Preferred username </p><p> d) Telephone number </p><p> e) Password </p><p>3.4 Once you have completed the registration process, you will be a registered member of the Application ('Member') and agree to be bound by the Terms. </p><p>3.5 You may not use the Services and may not accept the Terms if: </p><p> f) you are not 16 years old or in the High secondary school to form a binding contract with Leonie’s Caring; or </p><p> g) you are a person barred from receiving the Services under the laws of Australia or other countries including the country in which you are resident or from which you use the Services. </p><p>3.6 As a Member, you agree to comply with the following: </p><p> h) you will use the Services only for purposes that are permitted by: </p><p> a. the Terms; and </p><p> b. any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions; </p><p> i) you have the sole responsibility for protecting the confidentiality of your password and/or email address. Use of your password by any other person may result in the immediate cancellation of the Services; </p><p> j) any use of your registration information by any other person, or third parties, is strictly prohibited. You agree to immediately notify Leonie’s Caring of any unauthorised use of your password or email address or any breach of security of which you have become aware; </p><p> k) access and use of the Application is limited, non-transferable and allows for the sole use of the Application by you for the purposes of Leonie’s Caring providing the Services; </p><p> l) you will not use the Services or the Application in connection with any commercial endeavours except those that are specifically endorsed or approved by the management of Leonie’s Caring; </p><p> m) you will not use the Services or Application for any illegal and/or unauthorised use which includes collecting email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorised framing of or linking to the Application; </p><p> n) you agree that commercial advertisements, affiliate links, and other forms of solicitation may be removed from the Application without notice and may result in termination of the Services. Appropriate legal action will be taken by Leonie’s Caring for any illegal or unauthorised use of the Application; and </p><p> o) you acknowledge and agree that any automated use of the Application or its Services is prohibited. </p><h4>4 Use of the App </h4><p>4.1 The App is intended to facilitate the rostering and scheduling of in-home care services provided by Leonie’s Caring. You agree to use the App solely for lawful purposes and in accordance with these Terms. You will not: </p><p> p) Use the App in any manner that could damage, disable, or impair the App's functionality. </p><p> q) Engage in fraudulent activity or provide false information. </p><p> r) Attempt to gain unauthorized access to any features, data, or systems associated with the App. </p><h4>5 Services Provided </h4><p>5.1 Through the App, Leonie’s Caring provides access to a variety of in-home care services, including but not limited to: </p><p> s) Scheduling of caregivers for in-home care services. </p><p> t) Viewing and modifying schedules for care recipients. </p><p> u) Communication features between caregivers and care coordinators. </p><p> v) Notifications and reminders related to appointments. </p><p> w) Details of the services offered may vary by location and will be outlined upon registration and use. </p><h4>6 User Responsibilities </h4><p>6.1 As a user of the App, you agree to: </p><p> x) Cooperate with caregivers and staff in the execution of services. </p><p> y) Keep all relevant contact and medical information accurate and up to date. </p><p> z) Notify Leonie’s Caring promptly if there are any issues with scheduled appointments, such as cancellations or changes. </p><h4>7 Privacy and Data Protection </h4><p>7.1 Your use of the App is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of your personal information as described in our Privacy Policy. </p><p>7.2 Leonie’s Caring takes your privacy seriously and any information provided through your use of the Application and/or Services are subject to Leonie’s Caring's Privacy Policy, which is available on the Application. </p><h4>8 Intellectual Property </h4><p>8.1 All content, features, and functionality available through the App, including but not limited to the design, text, logos, graphics, and software, are owned by Leonie’s Caring or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any content from the App without prior written permission from Leonie’s Caring. </p><p>8.2 The Application, the Services and all of the related products of Leonie’s Caring are subject to copyright. The material on the Application is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Application (including but not limited to text, graphics, logos, button icons, video images, audio clips, Application, code, scripts, design elements and interactive features) or the Services are owned or controlled for these purposes, and are reserved by Leonie’s Caring or its contributors. </p><p>8.3 All trademarks, service marks and trade names are owned, registered and/or licensed by Leonie’s Caring, who grants to you a worldwide, non- exclusive, royalty-free, revocable license whilst you are a Member to: </p><p> aa) use the Application pursuant to the Terms; </p><p> ab) copy and store the Application and the material contained in the Application in your device's cache memory; and </p><p> ac) print pages from the Application for your own personal and non- commercial use. </p><p> ad) Leonie’s Caring does not grant you any other rights whatsoever in relation to the Application or the Services. All other rights are expressly reserved by Leonie’s Caring. </p><p>8.4 Leonie’s Caring retains all rights, title and interest in and to the Application and all related Services. Nothing you do on or in relation to the Application will transfer any: </p><p> ae) business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright, or </p><p> af) a right to use or exploit a business name, trading name, domain name, trade mark or industrial design, or </p><p> ag) a thing, system or process that is the subject of a patent, registered design or copyright (or an adaptation or modification of such a thing, system or process), to you. </p><p>8.5 You may not, without the prior written permission of Leonie’s Caring and the permission of any other relevant rights owners: broadcast, republish, up-load to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Services or third party Services for any purpose, unless otherwise provided by these Terms. This prohibition does not extend to materials on the Application, which are freely available for re-use or are in the public domain. </p><h4>9 Third-Party Links </h4><p>9.1 The App may contain links to third-party websites or services. These links are provided for your convenience, and we do not control or endorse these external resources. We are not responsible for any content, services, or products provided by these third parties. </p><h4>10 Termination </h4><p>10.1 Leonie’s Caring reserves the right to suspend or terminate your access to the App if we believe that you have violated these Terms. Upon termination, your account and any access to the App will be disabled. </p><h4>11 Limitation of Liability </h4><p>11.1 To the fullest extent permitted by law, Leonie’s Caring will not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the App, including but not limited to loss of data, loss of business, or personal injury. Our total liability will be limited to the amount paid for services provided through the App. </p><h4>12 Indemnification </h4><p>12.1 You agree to indemnify, defend, and hold harmless Leonie’s Caring, its employees, agents, and affiliates from any claims, liabilities, losses, damages, or expenses arising out of your use of the App, including any violation of these Terms. </p><h4>13 Changes to Terms </h4><p>13.1 Leonie’s Caring reserves the right to modify or update these Terms at any time. When we make changes, we will post the revised Terms on this page and update the "Effective Date" at the top. You are responsible for reviewing these Terms periodically.
